Expert Witness Testimony, Petroleum Storage Facility Litigation

Mundell was retained by a major law firm specializing in environmental law, to provide expert witness testimony in various legal proceedings relating to a release of petroleum at a major bulk storage facility in the Midwest. Mundell reviewed the groundwater model and the resulting conclusions, finding significant flaws in the construction of the model and the interpretation of the actual groundwater flow conditions. Polynuclear Aromatic Hydrocarbon Distribution – Superfund Site

Mundell personnel were hired by the Koppers Company as expert witnesses to investigate data gaps, determine chemical source contributions as well as develop life-cycle remedial cost estimates, and testify in the trial proceedings for a lawsuit involving insurance coverage for impacted wood treatment sites. Mundell developed a three-dimensional model of the distribution of various organic chemicals across the site and using the Earth Vision software estimated the mass of site-specific contaminants of concern (COCs) that remained in the soil and groundwater. Mundell provided litigation support and expert witness testimony in a case involving a gasoline release from a Clark Oil service station in Clarkston, Michigan that affected nearly 200 residents in the area. Air Data Spatial Analysis at Chlorinated Solvent Impacted Site in Northwestern Indiana

Manufacturing processes at an industrial site generated hazardous wastes including multiple volatile and semivolatile organic chemicals (VOCs and SVOCs), heavy metals, and petroleum-related compounds. Nearby residents filed a class action lawsuit against the new property owner seeking damages for diminished property values and abatement of contamination alleged to have migrated from the Site to soil and groundwater beneath homes in a geographically-designated class area. No matter where you live, chances are there is a wetland nearby. (Wetlands go by many names: estuaries, bogs, swamps, marshes, playa lakes, and more). Keep lawns and driveways free of pet waste, fertilizers and motor oil. These pollutants can wash into storm drains and eventually reach a wetland.
