Mundell researched parcel ownership information and evaluated aerial photos and flood records to piece together a better understanding of a client site where polychlorinated biphenyl (PCB) was detected in the subsurface. While the findings were being considered in ongoing legal proceedings, Mundell worked with the EPA to develop a self-directed cleanup plan to guarantee the most potential resale value for the client……Read More »

Expert Witness Testimony, Petroleum Storage Facility Litigation
Mundell was retained by a major law firm specializing in environmental law, to provide expert witness testimony in various legal proceedings relating to a release of petroleum at a major bulk storage facility in the Midwest. Mundell reviewed the groundwater model and the resulting conclusions, finding significant flaws in the construction of the model and the interpretation of the actual groundwater flow conditions. Mundell created various visual aids and models to effectively communicate the relatively complex hydrogeologic concepts to people with little to no geologic background including the litigants, judges, and potential jurors in the case. …..Read More »
Polynuclear Aromatic Hydrocarbon Distribution – Superfund Site
Mundell personnel were hired by the Koppers Company as expert witnesses to investigate data gaps, determine chemical source contributions as well as develop life-cycle remedial cost estimates, and testify in the trial proceedings for a lawsuit involving insurance coverage for impacted wood treatment sites. Mundell developed a three-dimensional model of the distribution of various organic chemicals across the site and using the Earth Vision software estimated the mass of site-specific contaminants of concern (COCs) that remained in the soil and groundwater. Ultimately, the analysis was used to support source contribution analysis, and assign liability for the costs of cleanup……Read More »
Modeling Provides Confidence In Risk Assessment
Mundell provided litigation support and expert witness testimony in a case involving a gasoline release from a Clark Oil service station in Clarkston, Michigan that affected nearly 200 residents in the area. As part of the representation, Mundell developed a regional two-dimensional groundwater flow model and a chemical transport model that proved the potential impacts were confined to an area in close proximity to the station, and the remaining area would not be threatened……Read More »
Air Data Spatial Analysis at Chlorinated Solvent Impacted Site in Northwestern Indiana
Manufacturing processes at an industrial site generated hazardous wastes including multiple volatile and semivolatile organic chemicals (VOCs and SVOCs), heavy metals, and petroleum-related compounds. Nearby residents filed a class action lawsuit against the new property owner seeking damages for diminished property values and abatement of contamination alleged to have migrated from the Site to soil and groundwater beneath homes in a geographically-designated class area. Mundell was retained by a midwestern law firm on behalf of the property owner to render opinions regarding the work activities at the site. …..Read More »
